Legal Question in Insurance Law in California
Accident
My girlfriend got in a car accident and it was deemed not her fault. So far her car has been in the shop for 2 months and is expected to be there for another month. The other person's insurance does not want to pay for all of the car rental, they will only pay for 7 days of the rental saying that is how long it should take to repair the car. There is 8000 dollars worth of damage. Does the other persons insurance company have to put her in a rental car? What are the laws regarding this?

Re: Accident
The other person owes you for reasonable loss of use. If the shop has wasted time, the shop should be paying it. There is no requirement that the other insurance co put you in a car. You can sue for reimbursement, but may have to prove that the repair time was reasonable.
