Legal Question in Insurance Law in California
Accident recovery against insurance company
What is an insurance company liable to pay when therir insure is 100% at fault? I was hit from the rear on the freeway, and the other party's insurance totaled my car and wants to leave it at that. Also what is their responsibility to cover my rental costs?

Re: Accident recovery against insurance company
The insurance company is responsible for all of your reasonably foreseeable damages. Usually they will pay your rental car expenses for the time period from the crash until they make a reasonable settlement offer. By the way the settlement on the car should include sales tax.
