Legal Question in Insurance Law in California

arbitration letter

I was in a car wreck, hit & run, I am insured, also have uninsured motorist, my insurance co. has paid to repair my car, less the deductible, which I paid, they have paid all my dr. bills. Now its to settle my lost wages, trips to and from dr. for 7 months, and they say i have to send them a letter of arbitration, the year will end 6-9-2001 on my claim. what needs to be stated in this letter?

You have to file a suit against John Doe within a year of the accident. You can file it Monday the 11th since the 9th is Saturday. Did the carrier tell about this? They have to advise you of everything since you don't have an attorney. If they don't it is bad faith. Go to the nearest court house. Buy a copy of a form complaint. Fill in the blanks and check the appropriate boxes. Sign it and file it with the clerk. I don't know the value of your case so I don't know if you should be in Municipal or Superior court. Get something on file. The clerk will give you stamped copies if you prepare them. Then send a copy of the complaint to your adjuster. Then get a lawyer. I practice in California and Indiana.
