Legal Question in Insurance Law in California
Auto Accident
I was in a car accident where I was making a left hand turn (a big rig driver waved me on) and a lady was proceding straight and I broadsided her. A witness said that she was driving irratically. On the police report there was nothing marked for who's fault it was and there were no violations or sitations given. I am at a complete loss as to what is going to happen. I have min Cal insurance and no assets. What can she get out of me and what is the normal declaration of whom is at fault when it wasn't reported.

Re: Auto Accident
A few thoughts on this.
First, you should talk to the witness and get some details about how the other person was driving. You may have a case against the other driver.
Second, if you have no assets and you have the minimum limits of insurance, that would be all the person could get, unless they wanted to get a judgment against you, which would be worthless.
Third, if you want to know about fault, go read my blog, www.calpiblog.com. But, ultimately, it is up to your insurance company or a jury.
