Legal Question in Insurance Law in California

auto accident

I was doing a legal u-turn with my turn signal on and was hit by the car behind me on the driver side of my vehicle towards the rear. The other driver was alone and I had one passenger with me. We exchanged info. I did not have car insurance at the time of the wreck, and the the other person did. Signifigant damage was done to my car and my neck was hurt. The other driver was not hurt, same with the passenger in my car. The police were not called or involved in any way. My question is regarding my rights in this particular situation as it applies to the laws here in Los Angeles. I want to know where I stand if I did'nt have car insurance but it was the other drivers fault in the accident. Thank you.

You have the same rights you would have had if you'd been insured, except that you cannot recover damages for pain and suffering. You can still seek reimbursement for medical expenses, damage to your car, reasonable charges for renting a replacement, etc.
