auto accident
if a passenger in an auto accident gets hurt and has medical bills is th insurance company responsibile for the bills or does the expenses come out of a settlement the passenger might get?

The insurance company considers the reasonableness of the bills and includes them in an offer. However, if there is medical payments coverage, the insurance company should pay the bills directly.

IF you have a lawyer to properly handle the claim against the responsible parties, either the driver's insurance or the other driver's insurance will probably pay for your medical bills and other damages such as lost earnings and compensation for your pain and suffering. Be sure and retain a lawyer right away: under California law, if you snooze, you lose.

The insurer for the defendant (driver or other party) will include the amount of bills in determining the value of the case.
Separate from that insurer is the driver's insurer which may provide medical payments coverage - that will pay your bills because it acts as medical insurance for auto-related accidents.
