Legal Question in Insurance Law in California

My car was totalled by a guy who stole a truck and was running from police, he and his passenger jumped out and ran but were caught. My insurance company is going to pay me the bluebook but I am a victim and want to know if I should get an attorney or go to the reported insurance company for compensation? I was not hurt but I am losing $128 a day not being able to drive to work.

You might seek compensation from the CA Victim's Compensation Fund. You can file a lawsuit against the bad guy. His insurance company won't cover since it was an intentional act. You might consider making a claim against the owner's insurance if he/she was negligent in leaving the car open, keys in the car, etc.

If the car had coverage on it, make a claim against that policy for your damage and loss of use. The other carrier may not cover the conduct described, since it's arguably an intentional act.

If the other insurer denies coverage, you can make a claim under your policy uninsured motorist coverage.
