Legal Question in Insurance Law in California
Auto Insurance Premium Refund
hello, we called to remove one car from insurance that we sold, to get partial refund. Insurer asked about other 3 cars on the policy and how they were titled. They were all titled in our adult childs name (who is one of drivers named on policy, but not a primary Insured).
Insurer customer service rep then said NONE of the cars were insured because they arent owned by the primary Insureds (husband and wife)! But they didnt take any further action to cancel us.
Can we get a refund of all our premiums paid and how can we get the true answer whether they were not insured? We havent had any claims and would like to get all our thousands of dollars of premiums back if they werent properly insured!

Re: Auto Insurance Premium Refund
This is a tough situation. There are a lot of questions that need to be answered, including whether you had an agent or a broker and if this person knew about the title of the cars. Insurance companies usually ask to see the title or they pull the DMV report on the car to make sure you have an "insurable interest." You should contact an experienced insurance attorney so that you can provide additional facts. You will probably not be entitled to all of the money back, but you may be entitled to a partial refund.
