Legal Question in Insurance Law in California

beneficiary of a life ins. policy

My mom's husband died, there is a life ins polciy thru his work. Couldn't find the policy, called the employer. His employer stated the amount of the policy to be 10,000 and wouldn't provide copy because he said it was a corporate policy.I later found a copy of the policy that shows $100,000.When I called the ins comp to submit a claim because I didn't trust the info from the employer I found out that the beneficiary was changed in Dec. 2006 (he was already sick) from the company he worked for to thename of the owner of the company and a claim was already submitted by this person. My mom was always told that she was the beneficiary. She is contesting the beneficiary, but needs to provide supporting evidence of why she should be the beneficiary. The ins comp won't verify the amount or type of policy or whose signature is on the change of beneficiary form when it was changed. What would be the benefit of changing the beneficiary from the corporation to the owner of the corporation? Can an employer be the beneficiary of a policy if it's a group policy? Is the law different for an individual term life and a group plan? What should be the supporting evidence provided to the ins comp? Does it matter who paid the premiums?

Re: beneficiary of a life ins. policy

Have your mom write a letter to the insurer and demand payment, and instruct them not to pay anyone else. Keep a copy. Also get a lawyer immediately. He/she will know what to do.
