Legal Question in Insurance Law in California

beneficiary

I am the secondary annuitant and beneficiary of an annuitant contract that my mother established when my father died. My mother remarried 6 months after taking out the contract and then died one year later. According to the company, Her husband becomes the new owner of the contract and holds all owners rights...ie; the right to change the contract...which is the plan. What are my options? As this was not her intention.

Besides needing a copy of the annuity contract, application therefor, and all amendments/endorsements, and correspondence (the whole agent's file), I would review your mother's will and estate plan. This also included any prenuptual/marital agreement(s) with her 2nd husband. You need a lawyer for this matter.
