Legal Question in Insurance Law in California

beneficiary

I am the secondary annuitant and beneficiary of an annuitant contract that my mother established when my father died. My mother remarried 6 months after taking out the contract and then died one year later. According to the company, Her husband becomes the new owner of the contract and holds all owners rights...ie; the right to change the contract...which is the plan. What are my options? As this was not her intention.

Re: beneficiary

as with any contract or written agreement, the actual language within the document itself is what would be controlling. thus, in your situation, you may want to retain an attorney to review the contract at issue and give you a full rundown of your rights and/or legal options thereafter to completely protect your interests here. if you would like a free phone consultation, email us with your contact information today.

Re: beneficiary

Besides needing a copy of the annuity contract, application therefor, and all amendments/endorsements, and correspondence (the whole agent's file), I would review your mother's will and estate plan. This also included any prenuptual/marital agreement(s) with her 2nd husband. You need a lawyer for this matter.
