Blue Shield Insurance

How do I file a extension to protect the statue of limitation against a civil case that I want to file against my insurance company. Because of my disability I have not yet filed the complaint my time expires August 2009.

You can't extend the deadline unless the insurance company agrees. A written tolling agreement signed by you and by an authorized representative of the insurer will suffice; you need not (and cannot) file it with the court.

You should have a lawyer draft the agreement for you, since something you prepare is unlikely to meet all the requirements.

You can't unless all of the potential defendants agree in writing to either extend or waive the SOL. You will screw up your right to sue. Talk to a lawyer and protect yourself.
