Legal Question in Insurance Law in California

My boyfriend driving my car, wrecked it, will it be covered??

I let my boyfriend who is excluded from my insurance policy use my car to take our son to a doctors appointment. On the way home, he was in an accident only involving my car. My boyfriend and my four month old son were okay, they were transported in an ambulance to the hospital just to make sure, but my car is totaled. I added my boyfriend to my insurance policy last month and then took him off last week. I submitted a claim throught my insurance, they have not yet declined my claim, but it looks like they are going to. I had full coverage, w/o uninsured motorist. I am paying off my car and I still have 4 years left of payments. Is there anythink I can do, does the ins company or the lendor of my vehicle have to fix it? Please let me know what my options are and if I even have any options. Thank you for your time. It is greatly appriciated.

It depends on the coverage - was he excluded only for liability purposes (if he caused an accident) or is any damage to the vehicle under the collision coverage also excluded?

Contact a lawyer to see if the statutory liability under the vehicle code could possibly be triggered by a claim for your son? Or was the accident possibly caused by a third party, either a vehicle or a condition? If so, you have a claim against that other party separate from the claim under your policy.
