Google [insurance bad faith]. These are good lawsuits, if you are the policyholder. If you are not the policyholder (you are aggrieved that someone else's insurance wouldn't pay you for a claim) you only have the right to sue the other party, not his or her insurance company. You need to consult a lawyer before doing ANYTHING AT ALL with regard to an insurance claim involving bodily injury or significant money.

It would be a "bad faith" case. You would also have a regular breach of contract case, and perhaps a declaratory relief action. You should contact an attorney who works with insurance coverage because it is a fairly specialized area of law. Good luck.
