Sorry to hear you're having such difficult time with your insurance. First, visit the Department of Insurance's web site and get the lowdown on how to file a complaint against your insurance carrier. Second, do not give a statement to the other party's insurance carrier or their investigators. Third, see if you can move your car to some place where you will not be cited, as I do not believe your carrier will reimburse you for the citations (although technically you're entitled to it). Fourth, hire a lawyer promptly to handle these things. If you need help let me know.
You don't give a location, but if you need help in the San Francisco/San Jose area, or Sacramento, we may be able to help you. Give us a call or send an email if you would like a no-obligation initial consultation.
I previously worked for an insurance company claims department and I know how they are supposed to operate and it's not this way. If the other guy was at fault and the witnesses are favorable to you then the other driver's insurance carrier is obligated to pay on behalf of that negligent driver or your case might need to be litigated. Insurance companies play games with claimants too often which is why you would need to consult with an attorney about your rights. if you feel you need more advise and representation. You are entitled to that. Legal fees and legal costs for this type of case done on a contingency basis meaning no out of pocket expense by the client. It's all recovered from the proceeds recovered from that negligent driver's insurance carrier. I hope this helps. Bob Worth
