Car insurance

My car was rear ended and the other person's insurance paid for the repairs (bumper was repainted and ''fixed''). when I came to pick up my car after it was ''repaired'', the bumper had a gap and I had to leave it at the body shop longer. It has not even been a year and the paint is cracking and the bumper has a gap again. I will be calling the other person's insurance again, but do I have to go back to the same body shop when I am not satisfied with their work? I would like to go to a different body shop to have the work fixed right. Thank you for any help.

Very simply and generally unless the insurer demanded that you get the car fixed at their shop, they are not responsible for negligent repairs. But the statute of limitations for property damage is three years, so if you did not sign a release, you can reassert your claim. If you did release the defendant, then your claim is against the body shop. You did not mention your own insurance - you should consider making a claim there.
