Legal Question in Insurance Law in California
my car was total and the insurance company deducted 1320.00 from my acv Previous my car was hit from anothet insure and they insurance pay for my damages.Well Allstate deducted that same amount.. Are they duoble dipping? how you deducted from something you didn't pay for.

From the way you present your question, I assume you did not get the previous damage repaired even though you received the $1,320. settlement money. If that is the case, the determination of the value of your car as a total in the new accident is correct to deduct the $1,320. in unrepaired prior damage. The concept is that your car was worth that much less before the second accident because it had not yet been repaired from the first accident.
