Legal Question in Insurance Law in California
We just had a child that lived for 16hours. Right after birth my wife called our insurance provider and added him to our plan. We had also spoke to several associates of our insurance plan before this event to be sure our son would be covered. Unfortunately he died after 16 hours.
We received a call today from our insurance company stating in order for our son to be covered he had to live for 14 days. None of this was ever explained to us. We spoke to several individuals from our insurance company and not once did anyone explain this to us.
What rights do we have? How do we fight this?

File a complaint with the California Department of Insurance against the insurance company that denied you coverage. The insurance commission will investigate your claim and advise you of further proceedings. Also ask the insurance commissioner if they have an advocacy program that will appoint you a advocate.
