Legal Question in Insurance Law in California
Hi, when a claim is filed within the E&O insurance coverage period (claims-based), and the insurance expired before the claim is settled. Will the insurance company still cover the loss of the claim.
Thanks,
Jeffrey

Definitely yes. Once a valid claim is made in which there is coverage, it does not matter when the claim is resolved, only when it occurred. Otherwise insurance carrier could get out of liability situations by cancelling policies before payment had to be made.

Mr. Shers is right, provided that the claim is otherwise valid. The insurer cannot deny the claim based upon the expiration date, but may deny it for other reasons.
