Legal Question in Insurance Law in California

Condo insurance

My condo HOA did some roofing which resulted in damage to my ceilings. The CC&Rs state that members are required to purchase real property coverage to insure their unit's improvements and contents against loss.

The HOA claims that I must claim damage against my own insurance.

Is that true? They did the damage. Can I look to them for repair costs or must I rely on my own insurance?

Re: Condo insurance

You are entitled to look both to the HOA and to the contractor/roofer which did the work. You have a liability claim against both, for your property damage.

The HOA should be joining in this demand. You are entitled to make a claim under your insurance, but you shouldn't use that if you don't have to. You might be non-renewed or incur increased premiums.
