Legal Question in Insurance Law in California
Covered on her insurance?
I was recently in a car accident with two other people. I was the back seat passenger. I hurt my teeth in this accident, chipping a couple of them. My mouth was bleeding so I left the scene, I was in walking distance, and my two friends failed to tell the police I was in the car. The next morning I went to the emergency room and told them what had happened, they wrote down that I was in an accient on the forms. I called the officer who was at the scene of the accident and he told me it was too late to be added to the report and to just tell her insurance company that I was in the vehicle. I went to the dentist and got estiments ($500-$1500, depending on if I need root canals or not). I gave the driver copies of all my bills to give to her insurance agency. I don't believe she told her insurance company anything about me being in the car. Should I pursue trying to get on her insurance claim? Would I even be covered on her insurance, because I am not on the report? Can I contact her insurance company directly? Please help me, thank you.

Yes, pursue the claim. You are only worried about proving what happened, and your story should be corroborated by one or both of your friends. My suggestion is to write the police explaining what occurred, and ask that your letter
be attached to the police report as a supplement thereto.
Always write the insurer for the other party, don't just rely on what adjusters tell you on the phone and be careful of what you say on the phone. It may well be written down differently that what you said.

You may want to go to the station in person and ask to fill out a report to be added to the original report. You have rights against the parties responsible for your injuries. Best to contact a lawyer to explain those to you in detail. Good luck.
