Legal Question in Insurance Law in California
Depreciation
Should an insurance company pay for depreciation of a vehicle that was hit in a DUI? My vehicle was less than a year old and now it's lost some value as I am obligated by law to report it was in an accident --even though it I was the victim of a DUI driver.

Re: Depreciation
You are really asking about dimunition of value. While you can recover this, it is a bit difficult and depends on a variety of factors, including the make/model of the car. Proving this can be difficult. You may want to visit my blog, www.calpiblog.com, where I have discussed this. If you have questions about your car, feel free to send me an email.
