Driving without insurance
Ok my brother inlaw just recently was in a car accident he rear ended a person that had no insurance is he still liable for repairs for the car without insurance

Yes, if he caused property damage.

Yes. In California, uninsured drivers cannot recover damages for pain and suffering, but they are entitled to recover for any other kind of loss, including damage to their vehicles, medical expenses and lost wages.
There is no good reason why a driver in your brother's position should be able to escape all liability just because the person he rear-ended happened not to have insurance.
