Legal Question in Insurance Law in California

Employer IMedical nsurance Premiums for High Risk Employees

I was diagnosed with breast cancer 5 years ago. I was treated and my health seems to be 100% o.k. I have been fired from my last two permanent jobs, weeks after my first 'annual' medical exam.[I was at these jobs for approx. 1 year prior to my firing.] Does the employer have to pay a higher insurance premium due to my pre-existing condition? Does this medical information become available to the employers insurance company once I started using the policy? Could I have been fired simply becasue I went for an exam?

Re: Employer IMedical nsurance Premiums for High Risk Employees

I think the premiums are based on group rates, not individual rates. But it depends on what kind of benefit your employer obtained.

Medical information is supposed to be private, insurers and doctors are not supposed to reveal the information to the employer under most circumstances. Try to get a copy of your personnel file and see why your termination occurred. If it was because of the medical information, you have a claim against the various parties.
