Legal Question in Insurance Law in California

Grace period to renew auto insurance

I have two questions:

1. Is there a grace period given to renew auto insurance. Example. Payment due by the 17th of the month, accident occured on the 19th of the same month and payment was actually made on 21st of the month. I have had the same policy for about 2 years, should I be covered?

2. My accident was during work hours and when I was on my way back to my office from my client's office. Should I be covered by my employer's automobile insurance?

Re: Grace period to renew auto insurance

1. No,there is no "grace period" for renewals of an auto policy. I am taking you at your word that this was a renewal, i.e., that the policy expired on a given date and you were offered the renewal thereof. If this was a termination for a non-payment of premium (called a cancellation) then there is a ten day prior notice required.

2. Yes, your employer's policy could be implicated since your services were within the course and scope of your employment in seeing clients at their offices and then returning to your employer's office. What you don't know is if your employer purchased non-owned auto coverage, which is fairly standard in most CGL policies.

3. Your employer may also be required to defend and indemnify you pursuant to Labor Code Sec. 2802, separate and apart from any insurance coverage it may have.
