hit outside of car
I was hit by a dodge durango in a parking lot. The durango instead of backing up she went forward and crossed the solid line in the parking lot. I was hit in the back and there was no damage to my car. The other parties insurence company told me that they wouldnt pay anything passed the ER visit. I called lawers all over humboldt county california nd they told me since i was outside the car there was nuthing they could do for me. this happend 3 months ago and now i get a letter telling me to settle in 10 days or this case will be closed. There insurence company knows i cant get a lawyer. Can i just take the person who hit me to small claims courty?
PS. After i was told by several lawyers to just try to settle with the insurence company i did the recording thing BUT never sighned a release of medical. please let me know if i should just give up.

You can take the other party to small claims court and pursue recovery up to $7,500.00. The carrier letter doesn't impact the statute of limitations. You have 2 years from your accident date to sue for bodily injury, and 3 years to sue for property damage.

Ignore the adjuster. They like to close files. Sue the other person in small claims court.
