Legal Question in Insurance Law in California
someone hit and ran the side of my truck in a parking lot.
my insurance company says they will send a check to ME (it's been appraised).
since the incident occurred something has happened in which i have need of the cash more than i need to get the truck fixed right now.
is it illegal to NOT use the money to pay for the truck ?

Unless there's a lienholder on the truck -- in which case the insurance check would be payable to you and the lienholder -- the money is yours.

Mr. Stone is right. But if you don't repair the car and later get into another accident, you may have a hard time proving how much damage the new accident caused.
