hit and run

my wife was driving down hwy. other car backed out of driveway she hit the car ,the car took off ,police came,she had b.a.l. of 0.8 will ins fix my car and hospital bills???

Who hit and ran? and who had the blood alcohol content .08? If the other driver took of and your wife had the BAC .08 then what is the police report say about the primary cause of collision? If it was not her fault then your wife should be able to recover.

I am presuming that you mean the other driver was drinking and hit and ran. If so, and the other driver had insurance, you can claim against their insurance. If no insurance, you can go after personal assets or make a claim under your uninsured motorist coverage. You should seek the advise of an attorney.
