Legal Question in Insurance Law in California
Homesteading my home
My son died in a motor vehicle accident where he ran head on into another car. He was driving my car but had his own insurance which is not adequate to cover the damage to the car or the injuries to the other car occupant. I have received a letter from his insurance stating that I may be held personally responsible for any costs above his insurance coverage. Can I homestead my house now in order to protect it in case there is a lawsuit?

Re: Homesteading my home
Consider turning this in to your own auto insurer, as it was your car. The owner has limited liability in most circumstances (negligent entrustment of the vehicle) so homesteading may not be necessary. See what your insurer says, but you might have to talk to an attorney to make sure between the two insurers, you are protected.
