Legal Question in Insurance Law in California
Our house went into foreclosure, talking to the insurance agent for our HO ins. he stated that we were getting a refund. Also the bank called to cancel the policy. We paid the homeowners ins ourselves, not through the bank. The refund was sent to the bank and was cashed by the bank? Also the policy was cancelled on 12/3/09 and we were not out until 12/13/09. Please help. Thx.

Contact the insurer directly and find out where is the check which was supposed to be sent to you. Demand the insurer pay you. It might be their problem with the bank if they issued the check to the wrong party. But you have to look at your policy (the lender's endorsement) and see if the bank has a right to any returned premiums, which are not the same as insurance proceeds.
