Legal Question in Insurance Law in California
my husband was negligent and hit another cyclist while cycling. She was injured and needs surgery, but has no medical insurance. What options could we pursue?
1. Victims own car insurance for bodily injury medical expenses.
2. Our Liability/Uninsured motorist car insurance policy w/ 100,00/300.00 limits. However, our Car insurance co. (esurance) states that bikes are not covered, and will deny claim.
3. The victim does not have medical insurance, even though it is mandatory in California.
We have no assets, we rent, and have no renters insurance. What are the legal options in this case?

She can sue your husband and get a judgment against him.
Even if the victim has insurance that covers this accident, she can sue your husband for her injuries. The insurers would be entitled to recover what they'd paid from the proceeds.
Your husband should discuss the case in detail with some local attorneys. They will be able to tell him what options he might have.
Good luck.
