Insurance after the accident

My daughter was involved in an accident. The same evening she bought car insurance. She told the insurance sales person about the accident and they told her that she would be covered for the accident. The insurance company is now declining her claim. Is there anything that she can do about it? Is there any law that she is covered under? Please advise......

The accident is covered under insurance contract law. Since the contract was not in effect when the accident happened, there is no coverage.

Thanks for your question. If your daughter was not at fault, the fact that your daughter did not have insurance (the prior reply is accurate) does not mean that she does not have legal recourse. The other party would be liable for her property damage, medical bills and lost wages, but not for pain and suffering due to your daughter's lack of insurance (Proposition 213). If your daughter was not at fault, she should seek an attorney.
