Legal Question in Insurance Law in California

Insurance Claim

Hello -

I am in the process of an insurance claim with Geico auto insurance. We are still trying to declare fault on the accident because it was a chain reaction accident and I was the last car involved and than the first car left the scene. Now I got a letter in the mail saying the passenger of the vehicle I hit is filing a bodily injury claim against my policy and has retained the services of an attorney. The attorney is asking me to release information regarding the bodily injury limits on my policy should I agree to divulge the bodily injury limits when it only goes up to 15,000 because at the time of the accident I only had basic liability insurance as my coverage. Can that passenger come after me for all of her medical bills when I only hit their car because they hit the car in front of them?

Re: Insurance Claim

Give the letter to your insurance company. It will get you a lawyer to handle the claim.

Re: Insurance Claim

Technically yes, but as a practical matter, it probably won't happen. If it's a minimum limits policy most plaintiff attorneys will settle for policy limits and go away. I see no harm in releasing the policy limits because it's discoverable in litigation anyways.
