Legal Question in Insurance Law in California

Insurance-denied coverage

I receieved a form for insurance to check off if i want medical, rx, etc... I checked medical. Received a bill for med and rx. I called told them i only want medical why did they bill for med and rx. they checked and said, i see you only checked medical. Ill take off the rx and you will owe only the price for med. i sent the price quoted over the phone. they cancelled it because i didn't pay the med and rx. I called and explained they said nothing they can do. I now owe 10000 dollars plus in med.bills. do i have a case?

Yes, go to small claims court and subpoena your original application from them.

Re: Insurance-denied coverage

Do you have the cancelled check for the premium you did pay? If so, you probably are covered for the medical bills. You do have a case if the insurer refuses to pay those bills. Get copies of your phone bills for the calls to the insurer where you were told what to do and how much to pay.

Send the medical bills with a letter to the claims department of the insurer with a demand to pay them. Do everything by letter. Or you should see a lawyer who will do this all for you.
