Insurer tries to rip off the victim of an auto accident
We are at a dilemma as to what to do next with an insurance company that is refusing to pay us what our vehicle is worth. We have been over it multiple times and mailed multiple letters and they act as if they just don't hear and keep giving us the dollar amount they want to settle for. Their client totalled our vehicle and we are the ones being put through the wringer. Help!!!

The insurer for the defendant who hit you has
no real obligation to treat you like they insure you. They
will try to pay as little as possible since
you have only one other alternative: sue the
defendant.
Your own insurer should become involved under
your collision coverage. Then only your
deductible will be what you pay, and you can
either let your insurer sue for reimbursement,
or you can sue for your own damages (loss of
use, rental, personal injury, etc.)

This is a very common problem. If this is your insurance company then your next step would be an appraisal under the terms of your policy. If it is the insurance company of someone else who damages your car then your next step is a lawsuit.
