Legal Question in Insurance Law in California

I was involved in a car accident that wasn't my fault. Now the insurance company isn't fixing my vehicle to its former condition. They seem to have a rebuttal for everything I bring up. The paint doesn't match throughout the truck, one part of the truck still has damage, the shock are blown out and being a rear end accident there is a vibration which I've been advised is probably the driveshaft. But because the u- joints were replaced several months ago they say they won't cover it and because the shocks were over the recommended miles they won't cover it. They have a way out of everything, even though I have a letter from them saying I deserve to have my vehicle repaired to it's prior condition. And they put two front tires that don't match my back tires. Please tell me what I can do besides get a second opinion at my own cost. Thank you, Eric S. Jackson.

It won't cost you to get your own repair estimate from a repair shop or dealer that you trust. Those are free. With a complete estimate showing what is needed and how much it will cost, demand the insurer pay to have it done at your own shop. Repair shops can ususally work something out with insurers, so let your shop try.

Insurer's can be held liable for shoddy repairs at shops the insist you use. If this doesn't work (and do this with letters, not phone calls) then take them to small claims court or contact an attorney.
