Legal Question in Insurance Law in California
legal action against insurance brooker
My broker sold me a policy based on replacement value of the building (I was paying for much higher coverage than the cash value) , now that the building is on fire I find out I have only cash replacement value. Insurance company (Fairplan) estimate is 60% less than the actual replacement value. If I sue the broker Can I claim the difference between replavement and cash value or I am just am entitled to difference in higher premium I paied the broker ? My guess is Fairplan will not take responsibility for the Agent, So I have to bring legal action against the broker.
