Legal Question in Insurance Law in California
Legal age for insurance purposes.
An applicant for an insurance policy represents himself to be age 59. He dates the application on the day of his birthday yet representing himself to be 59. He maintains that he is not age 60 until the hour (exact time) of his birth. The insurance company issued a policy at age 60 notwithstanding the representation of the applicant. Is there any case law or statutory law that would support the applicants position that although it was his birthday, he was still age 59 at the time of application?

This is a question that would have to be specifically research but it is doubtful such a silly argument would ever prevail.
