Legal Question in Insurance Law in California
Can liability be transferred to the responsible party?
My husband allowed his 18 year old daughter to drive his vehicle. She is not on the insurance policy. She rear-ended another vehicle. He only has the limited allowed coverage on his vehicle. After
exchanging information with the other driver (no personal injury occurred) and after an initial investigation by insurance parties...he is now liable for her accident because he is the owner of the truck. My question...since she is of legal age and is a licensed driver...can she be made responsible to pay the total amount damage she caused to this other vehicle...and if so, how would we be able to do that?
Thank You.

Re: Can liability be transferred to the responsible party?
She can be held responsible and legally she is reponsible. However, the owner of the vehicle is also responsible. Your husband could sue his 18 year old daughter to get her to pay him back, but do you really want to encourage that? In the future, if he does not want to be responsible for the damage other people cause while using his vehicle, he should not let anyone else drive it.
