Legal Question in Insurance Law in California

Long Term Disability and kidney failure

While on my job I was diagnosed with chronic kidney failure. It has progressed to stage 4. I have long term disability with my company for the last 7 years.

If my job lays me off before I go on dialysis and am unable to work, can I make any claim on my long term disability since most of it progressed while I was on the job?

Re: Long Term Disability and kidney failure

I am sorry that you have problems with your kidneys. Yes, you can claim LTD. But you will need to get a lawyer as they will fight you every step of the way. If you think you are going to be laid off, and your company is large enough to be covered by FMLA/CFRA, you might want to take FMLA/CFRA leave. Other issues may arise if your employer is a public entity, is a federal contractor, or is unionized.
