Legal Question in Insurance Law in California
Loss Wages Due to Accident
My wife was involved in a car accident (California). She was 100% not at fault. As a result, her doctor relieved her from work for a couple of days. Question -- does she have any recourse for loss wages against the party who hit her, being that she is paid on an hourly basis?

Yes.

Yes. She should get a letter from her employer verifying that she missed time from work and her hourly wage. This, along with the doctor's note taking her off of work, would be sufficient proof of her wage loss.

Yes, she is entitled to be compensated for loss of past and future wages (even for the time she had to go to physical therapy), medical expenses, future medical expenses and pain and suffering. call us at 213.388.7070 if you have any questions.
