Medical C.O.B.R.A. notification and divorce

Hi,

My divorce has been final since 1996. Through my EX's company I have received continued medical insurance.My EX has payed a portion to continue me under this companies medical/dental policy. Voluntarily, not as a "court order". We where told that unless "he" my ex "removed" me coverage would continue.

His company is now involved in a VERY large merger with another LARGE corporation and the company insurance carrier & policies are to change come July 1999. He did not add my name to the changes....but, I have not received any COBRA papers allowing me to continue coverage at my own expense OR even a notice of disconinueance of coverage.

My question....am I OR am I NOT entitled to be protected under the COBRA guidelines since I have always been covered by his company.

I found out about these changes only by fluke and NOT by any other source ie; the company OR my Ex husband! What ARE my rights, if any???

I would go back to your divorce attorney and have

him follow up on this. Your question is not just

about insurance law, it gets into Federal Labor Law

and family law. Since I assume your right to medical

coverage flowed from your property settlement

agreement in the divorce, and the decree filed

therein, that should be your starting point.
