Legal Question in Insurance Law in California

Do They Have The Right

I had paid my yearly dues in full and then I just received a notice today 08/06/04 that there is an increase in my policy and that now I have to pay $30.18 more plus $10.00 to make the payment of $30.18 or if I failed to pay this amount that they would cancel my insurance. Do they have the right to do this after they have already gave me a price and I paid it in full? I did go ahead and pay the additional amount but if they are wrong how do I get back the mony?

Ask them to correct the error. If they refuse, file a complaint with the Insurance Commissioner's office. They have their forms on-line, I believe at www.insurance.ca.gov.

Good luck.

Why don't you call the agent and ask about what appears to be a billing mistake. If you pay the additional amount, and find out you do not owe it, you might be able to credit it for the next year. If you think you are being cheated, then get another insurer to cover you and have your policy "cancelled flat" so all of the premium is returned.
