Legal Question in Insurance Law in California
If the plaintiff files a Braech of Contract Lawsuit and it is answered with a motion to dismiss or quash without grounds would I file a Motion vis CA Practice Guide under Discovery or file a Motion back to dismiss their dismissal on grounds that it was without merit?

People who don't know what they're doing shouldn't be filing lawsuits.
I'm afraid you are in way over your head. Your question doesn't even make sense.
You should try to get a lawyer to represent you or, at a minimum, to advise you while you remain in pro per. Even if your case has merit, it is quite plausible that you have already made serious mistakes which will damage your chances. The longer you represent yourself, the more of these mistakes you will make and the more damage they will cause. This is not something you should be doing on your own.
