Legal Question in Insurance Law in California

premium payment

I paid my life ins on 12-26-06 the check cleared my bank on 1-9-07. They sent a refund check with cancelation notice 5-8-07,check was dated 5-1-07. Can they do this? Thanks Bill

Yes. The cancellation notice has to give you a certain amount of time. But, they can write you the check any time prior to that. Depending on the reason for cancellation, the notice they have to give you differs.

If the premium was paid on time (12/26), no. It is too late. If the premium was paid late, it depends.

If you cash the check, a refund you said, you have agreed to what they did, right or wrong. If you did not cash the check, then don't and send it back and hold them to the policy for another term.
