Legal Question in Insurance Law in California
Hello and my question is that I got into an accident last year 2010 in December. It was raining heavy for around 5 days straight and on the 4 day of this weather I hydroplaned and totaled my car. I was driving on a straight away on the freeway going around 50mph which I felt with my judgement was safe. I drove this speed for at least 10 miles until I hydroplaned. I crashed into the side wall divider with no injuries to myself or anyone else. I was in the vehicle solo and no other vehicle was included in this accident. So my question is will this accident be considered me at fault which will result in my insurance rates to go up? Like a accident at fault with no injuries? If so is there a way to fight this?

1. Yes

3. Probably not
Pretty much everyone who gets in an accident thought they were safe until the accident happens. Clearly you were not actually driving at a safe speed for the conditions, regardless of what you thought. Therefore, Mr. Stone's answers are exactly correct.
