Legal Question in Insurance Law in California
Rear end collision
Hello,
My wife was rear-ended in my vehicle on March 98'. At the time of the accident, my wife was pregnant and my 2 yr. old son was also in the car. She does not posses a drivers license. But I do have car insurance under my name. The car had some rear end damage but everyone in the car was not hurt. She did go see a doctor for a check up though. She had slight back pain for a few days.
We were able to collect $666.00 for the rear bumper repair (we had to fight their $450 offer). It doesn't include or help with a car rental.
The other party's insurance company is trying to compensate my wife with $250.00 for personal injury and nothing for my son. As of yet, we have not yet settled for any amount. My neighbor who works for AAA insurance company says that's a slap in our face. We should receive a lot more. What can we do since she doesn't posses a drivers license? Does that matter? How much are we entitled to? Should we get a lawyer? Help please!

For a sore back that got better in a few days it seems to me $250 is OK. You can fight it and you might get $100 or $200 more. It does not matter that your wife didnt have a drivers license. I do not think it would be worth hiring a lawyer for a case this size.
