Legal Question in Insurance Law in California

Rear Ended by Insurance Company

I drive an exotic sportscar, I was rear ended. Contacted my insurance company, they arranged for my car to be repaired by a specialty shop of my choice. I was contacted by the other guys insurance company. They approved the work to be done from the specialty shop. They sent a check for the repairs and for rent a car fees for 7 days only. I cashed both. Repair facility had my car for over a week when I received the checks. The repair facility had the car 30 days. The repairman said, it took a week to get an approval, another week and a half to send away for parts, and another 3 days to send the parts out for painting. On the bill from the repair facility it says 16 labor hours. Those hours are for removing the old and installing new parts. It doesn't include other work hours done. So the insurance only sees 16 hours total. They said, it only should have took a week at any other average repair facility. They won't pay rental fees for more than a week. They don't understand this isn't an average vehicle. The insurance co wants me to sign off and give me $500.00 for medical and nothing else. My question: Why am I not entitled to collect for the remaining 23 days for rent a car fees?

Re: Rear Ended by Insurance Company

from the facts given so far, you definitely should not settle with the insurance company, especially in respect to your medical expenses if in fact you were hurt, without attorney representation. furthermore, you should indeed be entitled to the 23 days of additional rental car coverage if that was in your policy and the insurance company specifically told you to seek the specialty shop of your choice to get the repairs done, especially if this is not an unreasonable timeframe for such a specialty shop to take to make repairs by industry standards. feel free to email me more specifics of your case if you would like further legal assistance and/or representation on this matter.
