Legal Question in Insurance Law in California

If I am rearended, does it matter if I have auto insurance or not? Will it make a differance in whether or not I can file a claim? Can I receive compensation for my damages if in fact the vehicle I was driving is not insured? The other driver has admited fault ( he hit me in the back ). He hit the car I was towing, totaling both cars. Must he pay for damages to both vehicles, even if neither are insured?

If a trier of fact (or his insurance company) determines that he was at fault, he is required to pay for the damages to the vehicles and your medical bills -- but not your pain and suffering.
