Legal Question in Insurance Law in California

How to resolve disputed insurance bill

My business libiality insurance carrier is threating to turn a disputed bill over to collections. I

cancelled the entire policy over a year ago with the agent (via certified mail). However, the agent failed to cancel a ''rider'' policy. I responded to the insurance carrier's payment notice with a detailed letter including copies of my correspondence with the agent (also sent certified mail).

Nonetheless, the carrier continues to threaten me with collection. Question: How can I prevent or deter the carrier from turning the matter over to collections and causing damage to my personal credit? Can I file a complaint with the California Dept. of Insurance? Can the insurance company turn me into collections without responding to my dispute claim? If so, can I sue them for damaging my credit? The amount in question is under $500. Thank you for your help!

Re: How to resolve disputed insurance bill

Your question omits any reference to the agent. Why haven't you resolved this with him? He appears to be the one responsible, and he would have the ability to get to the insurer to stop this. Otherwise, complain to the commissioner/ or just call the collection department, get the name of a person who is handling the matter, and see to it that he/she gets a copy of your letter.

If that doesn't work, go up the ladder to authority of the insurer.
